Terms and Conditions for Online Payments

Missenden Abbey Standard Terms and Conditions

These terms and conditions apply to all online transactions made to Missenden Abbey Ltd which is a subsidiary business and owned by Buckinghamshire New University. If you are making an online payment for and invoice, please refer to section 1. When purchasing goods from the online store, please refer to section 2. For B&B/Accommodation bookings, please refer to Section 3.

When paying for invoices or on the store, please refer to the instructions on the page.

For Goods on the online store: immediate payment is required to secure tickets for events or goods being sold.

Missenden Abbey Ltd may change these terms from time to time without notice. Changes will apply to any subsequent transactions with Missenden Abbey Ltd.

These terms will be governed by and construed in accordance with English Law.

Section 1

Online Payments

Please read these terms carefully before using the online payment facility. Using the online payment facility on this website indicates that you accept these terms. If you do not accept these terms do not use this facility.

All payments are subject to the following conditions: –

  1. For Invoices or deposit payments: Thirty (30) working days is allowed for payment from the day that the invoice was raised. These dates will be stated on your invoice.
  2. Your payment will normally reach the Missenden Abbey bank account to which you are making a payment, the following working day.
  3. We cannot accept liability for a payment not reaching the correct account due to you quoting an incorrect account number or incorrect personal details.
  4. Neither can we accept liability if payment is refused or declined by the credit/debit card supplier for any reason.
  5. If the card supplier declines payment, Missenden Abbey Ltd is under no obligation to bring this fact to your attention. You should check with your bank/credit/debit card supplier that payment has been deducted from your account.
  6. The data that you provide during this transaction will only be used for the purpose of recording your payment. We shall abide by the principles of the Data Protection Act 1998 and ensure that the data is used for no other purposes and is disclosed to no third party.
  7. In no event will Missenden Abbey Ltd be liable for any damages whatsoever arising out of the use, inability to use, or the results of use of this site, any websites linked to this site, or the materials or information contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages.
  8. Refunds, if applicable, will only be made to the debit/credit card used for the original transaction.

Section 2

Sale of Goods

For Goods on the online store: immediate payment is required in order to secure tickets for events or goods being sold.

All payments are subject to the following conditions: –

  1. In these Conditions, the “Delivery Address” means the address specified in the Personal details you, the Buyer, have supplied.
  2. The contract will be subject to these Conditions of Sale, to the exclusion of all other terms and conditions.
  3. When creating a new account, you are providing Missenden Abbey with information which you are deeming to be true and accurate about yourself and therefore, any admin errors becomes the responsibility of the buyer(s) to inform the seller (Missenden Abbey Ltd) that a correction may be needed.
  4. If the delivery of goods (via email or postal service if applicable) is not made due to misinformation, the responsibility lies with you (the buyer), as you are deemed the informant of the information.
    1. Any costs that may be involved for re-delivery of the product will be liable to be paid for by the buyer.
  5. The Goods are at the risk of the Buyer from the time of delivery/collection. Ownership of the Goods will not pass to the Buyer until Missenden Abbey Ltd has received cleared payment in full in respect of the Goods.
  6. Subject to condition 5, any goods which may be received before the clearing of funds can be cancelled by Missenden Abbey Ltd and the product deemed invalid. The responsibility of reordering will lie with the buyer.
  7. Unless otherwise agreed by Missenden Abbey Ltd in writing, the price for the Goods will be the price as displayed on the Missenden Abbey Store Web Site. That price is subject to the addition of all costs or charges in relation to postage, carriage and insurance; where applicable, and payment must be received in advance in all transactions.
  8. The Buyer will make all payments due, in advance, under the contract of sale, without any deduction.
  9. The goods purchased must be for personal use or as a gift and not to be sold on to any third parties for profit or personal gain. Missenden Abbey Ltd reserves the right to cancel any order or goods without returning funds if this condition is found to be in breach.
  10. Missenden Abbey Ltd reserves the right to cancel any event that it may be advertising for. If the event is cancelled by Missenden Abbey Ltd (the seller), a full refund will be given to the buyer within 30 days. If a deposit has been paid for the event, this shall also be returned to the buyer. If a deposit is paid on goods and then cancelled by the buyer before Missenden Abbey Ltd cancels the event, the deposit(s) may not be return as the buyer has terminated the sale, prior to the event cancellation.
  11. Missenden Abbey Ltd reserves the right to advance or defer the dates of any event that it may be advertising for. If the event date is modified by Missenden Abbey Ltd (the seller), a full refund will be given to the buyer within 30 days or Missenden Abbey Ltd will give the option to transfer the tickets to the new event date. If a refund is requested, the deposit paid for the event shall also be returned to the buyer. If a deposit is paid on goods and then cancelled by the buyer before Missenden Abbey Ltd modifies the dates, the deposit(s) may not be return as the buyer has terminated the sale prior to the event date modification.
  12. Refund requests for any goods sold will be put under review by Missenden Abbey Ltd. The review will investigate the circumstance to ensure request validity.
  13. Any non-refundable deposit paid, as stated, is not refundable.
  14. Non-refundable deposits are also not transferable and there for the full cost of ticket or product must be paid by the substituting attendee and/or buyer.

Section 3

B&B/Accommodation Bookings

15. Amendments and cancellations are free up to 72 hours prior to date of arrival before 10.00am, afterwards first night rate will be charged against the guarantee credit/debit card. No shows will be charged the equivalent of the first night rate.

16. Advanced purchase reservations are non-refundable and non-exchangeable.

17. If you cancel after 10.00am hotel time, 2 day(s) prior to arrival date, the forfeiture amount will be 1 night(s) from the total stay.
